Agreement to Terms

Welcome to ByziBites! These Terms of Service ("Terms") constitute a legally binding agreement between you and Frist Development, LLC ("Company," "we," "us," or "our") regarding your use of the ByziBites application and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

Description of Service

ByziBites is a recipe and meal planning application designed to support Orthodox Christians in their fasting journey. Our Service includes:

• A comprehensive database of Orthodox fasting recipes
• Interactive fasting calendar with jurisdiction-specific guidance
• Meal planning and shopping list tools
• AI-powered pantry assist for ingredient recognition
• Community forum for discussions and recipe sharing
• Recipe ratings, reviews, and favorites
• Personalized recipe recommendations
• Free access to the ByziBites Culinary Compendium - a 1,000+ page PDF compilation of Orthodox fasting recipes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason.

User Accounts

Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Security

You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from your failure to maintain account security. You must notify us immediately at support@byzibites.com if you suspect unauthorized access to your account.

Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to other users or the Service.

Subscriptions and Billing

Subscription Plans

ByziBites offers the following subscription plans:

Payment Processing

Payments are processed securely through Stripe, a PCI-compliant payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annually). We do not store your full credit card information on our servers.

Billing Cycles and Renewals

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate. We will notify you of any price changes in advance.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and you will retain access to paid features until that time.

We offer a 30-day money-back guarantee for first-time subscribers to paid plans. If you are not satisfied with your subscription within the first 30 days, contact us at support@byzibites.com for a full refund. After 30 days, subscription fees are non-refundable.

Plan Changes

You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately, with prorated charges for the remainder of your billing cycle. Downgrades take effect at the start of the next billing cycle.

User-Generated Content

Your Content

You may post, upload, or submit content through our Service, including forum posts, comments, reviews, recipe photos, and other materials ("User Content"). You retain all ownership rights to your User Content.

License Grant

By submitting User Content, you grant ByziBites a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating and improving the Service. This license terminates when you delete your User Content or account, except where the content has been shared with others and they have not deleted it.

Content Responsibilities

You are solely responsible for your User Content and represent that:

• You own or have the necessary rights to submit the content
• Your content does not violate any third-party rights
• Your content complies with these Terms and applicable laws
• Your content is accurate and not misleading

Content Moderation

We reserve the right (but have no obligation) to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We may remove content and suspend or terminate accounts without prior notice if we determine, in our sole discretion, that a violation has occurred.

Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Harass, abuse, threaten, or intimidate other users
• Post false, misleading, or fraudulent content
• Distribute spam, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scrapers) without our written permission
• Impersonate another person or entity
• Collect or harvest user information without consent
• Post content that is obscene, defamatory, or hateful
• Promote violence or illegal activities

Violations of this policy may result in immediate termination of your account and potential legal action.

Intellectual Property

Our Content

The Service, including its design, code, recipes, text, graphics, logos, and other content (excluding User Content), is owned by Frist Development, LLC and is protected by copyright, trademark, and other intellectual property laws. The ByziBites name, logo, and associated marks are trademarks of Frist Development, LLC.

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include the right to:

• Reproduce, distribute, or publicly display our content
• Modify or create derivative works
• Reverse engineer or decompile the Service
• Use the Service for commercial purposes without our written consent

Recipe Attribution

Recipes in our database are sourced from various Orthodox Christian cookbooks and publications. We respect the intellectual property rights of recipe authors and provide proper attribution where applicable. Recipe content (ingredient lists and basic instructions) is extracted in accordance with U.S. copyright law, which does not extend copyright protection to factual lists of ingredients or procedures (37 C.F.R. § 202.1(a)).

Disclaimers

"As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

No Dietary or Health Advice

ByziBites provides recipes and meal planning tools for informational purposes only. We are not a substitute for professional dietary, nutritional, or medical advice. Always consult with your spiritual father or confessor regarding fasting practices, and consult healthcare professionals regarding dietary restrictions or health concerns.

Recipe Accuracy

While we strive to provide accurate recipe information, we cannot guarantee that all recipes, nutritional information, or fasting level designations are error-free or suitable for your specific needs. Users are responsible for verifying information and exercising judgment when following recipes.

Third-Party Content

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third parties. Your use of third-party services is at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIST DEVELOPMENT, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Service
• Any other matter relating to the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent or illegal activity
• Requests by law enforcement or government agencies
• Discontinuance or material modification of the Service

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by deleting your account through the settings page.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Jurisdiction

You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Oregon, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

Before filing any legal claim, you agree to first contact us at support@byzibites.com to attempt to resolve the dispute informally. Most disputes can be resolved this way.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Updating the "Last Updated" date at the top of these Terms
• Sending an email notification to your registered email address
• Displaying a prominent notice in the application

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.

We encourage you to review these Terms periodically to stay informed of any updates.
